The California Department of Housing and Community Development (HCD) is excited to release the Assembly Bill (AB) 2097 Technical Advisory, a key resource to help local and regional agencies, developers, and California residents build smarter, more affordable communities. What’s Inside? On September 22, 2022, Governor Newsom signed AB 2097 (Friedman, 2022), which added Government Code section 65863.2. This advisory is your go-to guide for understanding and implementing this law that prohibits local governments from imposing minimum parking requirements on developments located within ½ mile of major transit stops (with some exceptions). Why Does AB 2097 Matter? • More Homes, Lower Costs: Minimum parking requirements can add tens of thousands of dollars to the cost of each home and reduce the number of homes we can build. AB 2097 removes this barrier, helping prioritize homes in critical locations to increase transit ridership and reduce driving. • Healthier, Sustainable Cities: Less parking can lead to lower greenhouse gas emissions and more space for homes, parks, and businesses that make neighborhoods thrive.
